STALLION SERVICE CONTRACT

This service Is engaged subject to the following conditions:

1. A booking fee of $ _______________________ the above fee is payable with this contract, and the balance of $_________________ plus all unpaid expenses will be payable upon receipt of an Invoice or when mare leaves the farm, whichever Is first.  The booking fee is non-refundable.  The Breeder requires 48 hours’ advance notice when the Mare Owner wishes to remove his mare(s) from the farm.  The mare (and foal. If applicable) shall be released only upon payment In full of all outstanding invoices, including those from the attending veterinarian.

2. The mare shall be in healthy and sound breeding condition, free from infectious, contagious or transmissible disease. A current negative Coggins Test, photostat copy of registration papers (both sides), plus a health, worming and immunization record must accompany mare; It they do not, Breeders veterinarian will examine and/or test mare at Mare Owner’s expense.  Breeder reserves the right to refuse the mare if not in satisfactory condition or does not have test or records documents.

3. Stallion Manager agrees to provide suitable facilities for the care and food of the mare and/or foal while in his custody.  Mare Owner agrees to the herein enclosed rates regarding board, etc.  Stallion Manager will exercise judgement in care and supervision of mare and/or foal. Attending Veterinarian will examine mare for normal breeding conditions and will administer medical care as deemed necessary for their health and safety.  Mare Owner hereby consents to all medical care administered to the mare by Stallion Manager and/or Veterinarian.

4. Stallion Manager agrees to diligently try to settle Owner’s Mare.  Mare Owner agrees to give Stallion Manager ample opportunity to settle the mare. Breeder does not give a Live Foal Guarantee for any mare leaving the Farm unless the mare has been pregnancy-checked and found to be in foal by the Farm Veterinarian.  IF THE MARE LEAVES BEFORE PREGNANCY CHECKED, THEN ALL UNPAID BOARD, EXPENSES, AND BREEDING FEE BECOME DUE AND PAYABLE and the live foal guarantee then becomes void. If, however, for any reason the mare does not settle, Mare Owner will hold Stallion Manager harmless.  The above applies to the normal breeding period, February 5 through July 15 of each year.

5. LIVE FOAL GUARANTEED WITH RETURN PRIVILEGES.  This contract contains a “live foal guarantee” which means the newborn foal shall stand and nurse. It is understood that if the mare proves barren, aborts her foal, or foal is born dead, a return season will be guaranteed for the following year only.  Return privileges shall apply only if Stallion Manager receives proper notification within seven (7) days.  Proper notification shall be defined as follows:
Notice and written certification by a licensed veterinarian confirming mare has slipped or produced a non-viable foal, If mare owner fails to deliver her for rebreeding the following year ( _________ ) then any and all fees shall not be refundable and this contract is thereby cancelled.  The Live Foal Guarantee is non-transferrable.

6. It is further agreed that should the above named stallion die, or become unfit for service, or if the above named more dies or becomes unfit to breed, then this contract shall become null and void and both parties are relieved of any further obligation hereunder.  Likewise, any monies heretofore paid by Mare Owner toward the Stallion fee, with the exception of the non-refundable booking fee, shall be returned to Mare Owner. However, Mare Owner shall pay for all other expenses actually incurred.  However, both parties, Breeder and Mare Owner, have the option of accepting another Mare or Stallion as a replacement upon agreement of both parties.

7. A breeder’s certificate will be issued to the Mare Owner after all expenses have been paid In full and upon notification of the birth of the foal.

8. Waiver of Liability. Both parties agree that the breeding farm, the Stallion Manager, its owners, employees, and guests shall not be liable for any injury, sickness, accident or death of any horse on its premises.  The above Mare Owner, whose horse(s) is (are) under the care of Bricker Performance Horses will not be liable for any damage, injury or death to the breeding farm stallions, employees, veterinarians, or other animals in the care of the Farm, whether or not caused by his horse.

9. Mare Owner Is responsible for all insurance on mare and foal.

10. The Parties acknowledge that this agreement is made and shall be entirely performed within the state of California and shall be enforced under the laws of this State.

11. Additional condition shall be listed here and initialed by each party as a written mutual consent of the parties hereto. ______________________________________________________________________________________________

12. This contract represents the entire agreement between the parties. No other agreements, verbal or implied, are included unless specifically stated in this written Contract.

13. When the above named Mare Owner signs and returns this Contract to the Breeder, it will then be a binding contract on both parties, subject to the above terms and conditions.
